Some authors of Jurisprudence, especially Michel Villey, tried to present what they thought to be the aristotelic theory of justice, grounding in it their own theories. To Villey, pecifically, “the right” would be the correct translation of the Greek to dikaion. To defend, based on Aristotle, a conception of the just that refuses subjective elements of a theory of action is an error. And this error lies in ignoring a redefinition of to dikaion made by Aristotle in Chapter 9 of (...) Book V of Nicomachean Ethics. There, Aristotle adds to the objective conditions of the just and the unjust (EN V, 1-7) some subjective conditions referring to person who suffers the action. Only after correctly understanding these conditions we will be able to correctly understand the aristotelic theory of justice. As Villey and other authors ignore it, they err interpreting Aristotle and using him to found their own theories. (shrink)

Neste artigo, apresentamos algumas experiências realizadas na disciplina de Estágio Supervisionado em Educação Infantil I, do curso de Pedagogia da UNIVATES, no qual investigou-se as possibilidades de conciliar a funcionalidade do espaço da sala de aula dos bebês com objetivos pedagógicos. Os dados foram obtidos mediante a realização de filmagens, fotografias e do uso de Diário de Campo. Observa-se que buscar contemplar na sala de aula de Educação Infantil os interesses e necessidades das crianças e dos adultos, exige dos docentes (...) uma escuta sensível do que as crianças manifestam, bem como, a criação de novos materiais e uso de diferentes estratégias a fim de garantir a multissensorialidade do espaço. No decorrer dos últimos três séculos desenvolveu-se em ética uma dicotomia entre fatos e valores cuja influência ainda hoje gera discussões. Nesse ensejo, a intenção deste artigo é propor, a partir do realismo-cognitivo de Scanlon, uma leitura alternativa a respeito dessa dicotomia estabelecida entre fatos e valores. Em geral, boa parte desse problema deve-se ao motivo de que as reivindicações do domínio normativo são muitas vezes avaliadas a partir da ótica da ciência, isto é, da visão científica de mundo. Mas (...) conforme buscarei sustentar, é preciso que o domínio normativo seja avaliado a partir dos padrões de seu próprio domínio cujo elemento básico é a relação ser uma razão para. Verdades normativas são irredutíveis na medida em que são determinadas por certos padrões de resposta dentro de um domínio específico em si mesmo, o que no campo normativo é realizado pela ideia de reivindicações normativas puras. Assim, partindo-se do pressuposto de que verdades normativas são irredutíveis e que, nesse caso, podem ser verdadeiras ou falsas, o melhor modo de compreendê-las é a partir da relação R, sendo p um fato, x um agente, c um conjunto de condições e circunstâncias e a uma ação ou atitude. A partir desse padrão constituído no interior do domínio normativo, a relação R estabelece que p é uma razão para um agente x realizar uma ação ou atitude a no conjunto de condições e circunstâncias c. se isto estiver certo, então, ao menos em termos normativos, o hiato entre fato/valor parece ser transponível. O objetivo desse artigo será apresentar parte do debate atual sobre o papel da intenção na teoria da ação e na racionalidade prática. Para isso, iniciarei com a perspectiva do autor responsável pela retomada da filosofia da ação na contemporaneidade, Donald Davidson. Após oferecer uma breve exposição da concepção davidsoniana da intenção e da ação, e sobre os modelos teóricos “crença-desejo” e “crença-desejo-intenção” na filosofia da ação, pretendo desenvolver algumas considerações sobre o aspecto normativo da racionalidade prática (no sentido em (...) que envolve “razões para”) e o papel que a intenção tem nesse processo. Para isso, apresento o modo como Michael Bratman (1987) desenvolve uma linha de argumentação a favor de um tipo de função que a intenção pode desempenhar como input no raciocínio prático, argumentando em prol de um papel genuíno para a intenção em uma concepção de racionalidade prática. Por fim, apresento alguns desdobramentos da discussão sobre o modelo crença-desejo versus o modelo crença-desejo-intenção como propostas conflitantes para a explicação da racionalidade prática.AbstractThis paper aims to present part of the current debate about the role of intention in action theory and practical rationality. For this, I begin with the perspective of the philosopher responsible for the resumption of contemporary philosophy of action, Donald Davidson. After a brief exposition of davidsonian conception of intention and action, and of “belief-desire” and “belief-desire-intention” theoretical models in philosophy of action, I intend to develop some considerations about the normative aspect of practical rationality (in the sense that it involves “reasons for”) and the role of intention in that process. For this, I present the way that Michael Bratman (1987) develops a line of argumentation in favor of a certain type of role intention can play as input in practical reasoning, arguing for a genuine role for intention in a conception of practical rationality. Para isto, se delimita como a ideia de amizade se situa no sistema aristotélico, englobando o agir humano por meio da política. Num segundo momento, trata-se de elucidar as etapas do pensamento aristotélico da amizade mediante os conceitos de alma e virtude. Although empirical evidence may provide a much desired sense of certainty amidst a pandemic characterised by uncertainty, the vast gamut of available COVID-19 data, including misinformation, has instead increased confusion and distrust in authorities’ decisions. One key lesson we have been gradually learning from the COVID-19 pandemic is that the availability of empirical data and scientific evidence alone do not automatically lead to good decisions. Good decision-making in public health policy, this paper argues, does depend on the availability of reliable (...) data and rigorous analyses, but depends above all on sound ethical reasoning that ascribes value and normative judgement to empirical facts. Este ensaio teórico tem como objetivo central analisar e debater o pensamento, principalmente na área educacional, do pedagogista e filósofo austríaco Otto Willmann, considerado o fundador da pedagogia social moderna. Trata-se de um estudo de caráter bibliográfico, que faz uso, em primeiro plano, da única obra do autor traduzida para o português e de outras escritas por comentaristas contemporâneos, bem como textos recentes de reflexão, nos quais são analisados o contexto histórico, as influências que ele sofreu, como as teorias de (...) Johann Friedrich Herbart, a sua biografia, as suas obras e não somente a sua contribuição à história do pensamento pedagógico, mas também possíveis contribuições à situação educacional dos dias de hoje. Em um período de grandes mudanças de pensamento no Ocidente, principalmente no mundo germânico do século XIX, um dos aspectos discutidos é como Otto Willmann conseguiu conciliar o aspecto individual com o social na pedagogia, evitando alguns dos extremismos característicos de sua época, como o psicologismo e o determinismo sociais, sendo um pioneiro da pedagogia social. Além disso, busca demonstrar como ele se constituiu um intelectual público, no sentido cunhado por Henry Giroux, contribuindo para transformações em sua realidade, no caso, o Império Austríaco. Entende-se, então, que Willmann se tornou um pensador que buscou a conciliação entre os aspectos individual e social na pedagogia e na didática, justificando, a partir disso, a cientificidade de ambas as áreas, demonstrando a importância do estudo da sociologia e da história da educação como ciências auxiliares da educação. Em meio às clarividências de Sosípatra, veremos os episódios que a levaram ainda muito jovem às iniciações teúrgicas e algumas poucas cenas adicionais de sua vida adulta. This commentary defines what shared yet differentiated ethical responsibilities to tackle antimicrobial resistance (AMR) mean, by introducing a threefold principled account of AMR global governance. It argues that the principles of solidarity, subsidiarity, and stewardship can be especially helpful for further justifying some of the universal, differentiated, and individual responsibilities that Van Katwyk et al propose. The upshot of my threefold principled account of AMR global governance is a less ambitious AMR treaty, one that can only justify (i) universal duties (...) of global coordination (as per the principle of solidarity); (ii) differentiated duties to local communities, which bear the primary AMR responsibilities (as per the principle of subsidiarity); and (iii) individualized duties for ensuring truthful, evidence-based, consistent, and timely shared accountable communication (as per the principle of stewardship). This paper argues that the existing definition of pandemics is not nuanced enough, because it is predicated solely on the criterion of spread, rather than on the criteria of spread and severity. This definitional challenge is what I call ‘the conflation problem’: there is a conflation of two different realities of global health, namely global health emergencies (i.e., severe communicable diseases that spread across borders) and nonemergencies (i.e., communicable or noncommunicable diseases that spread across borders and that may be severe). (...) To put this argument forth, this paper begins by discussing the existing and internationally accepted definition of pandemics, its requirements, as well as its strengths (section 1). Section 2 then considers the problem with the standard definition of pandemics (i.e., the conflation problem) and some examples of it. O conhecimento abstrato é, nesse contexto, como clarividência da razão, o fundamento para se atingir o conhecimento puramente intuitivo. A partir da análise de algumas formas de conhecimento (conceito, sentimento e Ideia) apresentadas no tomo I da obra, tem-se uma diferenciação clara entre os âmbitos da explicação e da significação (...) do mundo na metafísica da vontade. Assim, o objetivo deste artigo é indicar um possível limite da filosofia, tomando como exemplo a tentativa de conceitualização do nada no último parágrafo da obra, e, por fim, propor uma reflexão acerca do papel do filósofo, para Schopenhauer, na negação da Vontade de vida. There are also magic pills that promise you happiness, by giving you the power to thrive and the endurance to conquer the world. Human rights advocates often use inflated and thus underspecified terminologies when addressing the content of their claims. One example of such loose terminology is the term ‘well-being’, as currently employed in connection with a definition for the right to health. What I call the ‘well-being conception of health’ conflates the distinct ideas of basic and non-basic health needs, as well as those of individual autonomy and freedom. I call this the conflation problem. This paper argues for the need of an (...) understanding of the right to health, nuanced enough to capture not only these distinct ideas, but also their moral relevance for the common good. (shrink)

This paper suggests that the focus on abortion legalization in the aftermath of the Zika outbreak is distracting for policy and lawmakers from what needs to be done to address the outbreak effectively. Meeting basic health needs, together with research and development conducive to a vaccine or treatment for the Zika virus should be priorities.

Mostraremos como o Fedro de Platão é um terreno atípico, cujo léxico e alguns conceitos são flutuantes dentro do próprio diálogo, dificultando comparações lexicais com outros diálogos. Nosso ensaio mostrará a flutuação e a inversão de valores desse léxico-conceitual no próprio Fedro, tomando como exemplo quatro termos chave: doxa, razão, Eros e retórica. Consideraremos o caráter metodológico e epistemológico que a comparação lexical entre diálogos implica, tomando o Fedro como exemplo cujo bordado, comparado aos demais diálogos, sempre parece às avessas. The reverse side of embroidery: doxa, reason, Eros, and rhetoric in the Phaedrus Abstract: We will show how Plato's Phaedrus is an atypical terrain, whose lexicon and some concepts are floating within the dialogue itself, making lexical comparisons with other dialogues difficult. Our essay will show the fluctuation and inversion of values of this lexical-conceptual in Phaedrus himself, taking as an example four key terms: doxa, reason, Eros and rhetoric. We will consider the methodological and epistemological character that the lexical comparison between dialogues implies, taking the Phaedrus as an example whose embroidery, compared to the other dialogues, always seems to be in reverse. Thus, like the experienced embroiderers, we will evaluate these terms not only by the manifest figure, but especially by its reverse side, whose interlacing must be as or more beautiful than the external side. This article challenges the orthodox view of international law, according to which states have no legal duty to cooperate. It argues for this legal duty in the context of COVID-19, based on the ethical principles of solidarity, stewardship, and subsidiarity. More specifically, the article argues that states have a legal duty to cooperate during a pandemic (as solidarity requires); and while this duty entails an extraterritorial responsibility to care for and assist other nations (as stewardship requires), the legal duty to (...) cooperate still allows states to attend first to the basic needs of those under their own jurisdiction—namely, fellow nationals and residents (as subsidiarity requires). The article provides a definition and philosophical justifications for this legal duty that are lacking in the literature by examining its application to a current COVID-19 controversy: namely, states’ responsibility to assist other countries in greater need by, inter alia, exporting at a discount or donating scarce COVID-19 treatments (including vaccines). In providing a principled tripartite account of pandemic governance, this conceptual and normative article offers a new lens for debating the potential international treaty for pandemic prevention, preparedness, and response that has now been drafted and is under negotiation at the World Health Assembly, by responding to the recent backlash against multilateralism by substantiating global co-responsibilities in times of pandemics and beyond. It is generally accepted that patents are a driving force for innovation through research and development. But the university's involvement in patenting is problematic as well. In particular, it is in tension with the idea of a university itself. If patents entail a restriction on the accessibility of the scientific knowledge that has been patented, and if the main purpose of universities is to produce and disseminate knowledge to the public, then, there is a tension: when universities patent their research (...) innovations, they are making the scientific knowledge they produce less accessible to the public. The paper argues that university patenting contradicts the very idea of a university as an institution whose mission is fundamentally to disseminate the knowledge it produces to the public. The practice of university patenting involves an un-academic attitude thus: by inciting an attitude towards knowledge that is not consistent with the proper attitudes and goals of a university, university patenting hurt.. This study argues against the expansive approach to the WHO reform, according to which to be a better global health leader, WHO should do more, be given more power and financial resources, have more operational capacities, and have more teeth by introducing more coercive monitoring and compliance mechanisms to its IHR. The expansive approach is a political problem, whose root cause lies in ethics: WHO’s political overambition is grounded on WHO’s lack of conceptual clarity on what good leadership means and (...) what health (as a human right) means. This study presents this ethical analysis by putting forth an alternative: the humble approach to the WHO reform. It argues that to be a better leader, WHO should do much less and have a much narrower mandate. More specifically, WHO should focus exclusively on coordination efforts, by ensuring truthful, evidence-based, consistent, and timely shared communications regarding PHEIC among WHO member-states and other global health stakeholders, if the organization desires to be a real global health leader whose authority the international community respects and whose guidance people trust. Neste artigo, buscaremos refletir sobre como Hannah Arendt concebe um certo tipo de educação ao mesmo tempo _conservadora_ e _revolucionária_. Este será, assim como a indicação de que pensar sobre a questão educacional das crianças e jovens diz respeito a uma crise mais geral na modernidade, um ponto de tensionamento rumo à hipótese segundo a qual é possível refletir sobre como inserir os imigrantes, refugiados ou apátridas em um local ao qual se dirigiram e que lhes é estranho. Para tanto, (...) o fio condutor desta argumentação será o conceito de natalidade, pois consideramos ser a partir dele que Arendt evoca a radicalidade da qual todos os seres humanos são portadores, isto é, a potencialidade de começar algo novo. Assim, articulam-se os tensionamentos entre conservar um mundo que é precedente aos que lhe são recém-chegados, tanto as crianças como os migrantes, ao mesmo tempo em que estes adicionam algo de si mesmo neste mundo para os que ainda estão por vir. In Hermias’ commentary on Phaedrus (In Platonis Phaedrum Scholia), it is possible to identify several direct references to the philosophers and pre-Socratic doctrines, including Pythagoras. We point out to three references to Pythagoras in Hermias: (1) Pythagoras is characterized as an unwritten philosopher, (2) there is a special connection with the divinities and Muses, and (3) there is a special connection with the Phaedrus dialogue, revealed by the affinity between Pythagoras and Socrates. We show how the explicit references to Pythagoras (...) in Hermias constitute a certain method of interpreting Platonism: as a philosophy manifested in writing, but which, at the same time, values the unwritten tradition, represented especially by Pythagoras and Socrates. We also demonstrate how the references translated and examined here reveal the image of this Neoplatonic Pythagoras of Hermias, an image which is not necessarily in tune with the oldest doxography, and which permits the reevaluation of Plato’s position as a philosopher who sought to combine unwritten doctrines with his explicit activity as a writer. From the scene of the singing cicadas in the _Phaedrus_, we will show the affinities between the mention of the dangerous sleep at noon (_Phdr_. 258e6-259d8) and a mythical episode in the life of Epimenides. Next, we will look at the possible affinities between the description of Dionysian madness (_Phdr_. 244d5-245a1) and the type of divination practiced by Epimenides of Crete (DK 3 B 1-25). From these approaches, we intend to describe and elucidate the common imaginary with which Plato elaborates (...) his reception and assimilation of the archaic poetic tradition in his philosophy. Nossa proposta neste ensaio é descrever a primeira problematização apresentada por Merleau-Ponty a respeito da noção de Natureza em seus cursos ministrados no Collège de France,defendendo a hipótese de que ele a constrói, em grande medida, através de um diálogo e de umainterpretação particular do pensamento cartesiano. Procuraremos mostrar que Merleau-Pontyreconhece em Descartes a permanência de uma ontologia implícita ou latente – coexistente com suaontologia “oficial” –, que “resiste” à formulação puramente inteligível da ideia de Natureza, e que,por isso mesmo, (...) preserva para ela o campo da existência e da realidade. The main objective of this work is to discuss the materiality of relationships and experiences of infants in early childhood education, based on a dialogue with the Brazilian curriculum guidelines for Early Childhood Education in 3 municipalities in the state of São Paulo, and with the concepts of technical objects and individuation developed by Simondon. This is a qualitative research that uses bibliographic and documentary research as a methodology and the production of cartographies of scenes in which relationships between babies (...) and objects are observed. The cartography used here is inspired by the records developed by Fernand Deligny (2015) and its appropriation for research with babies, as proposed by Julia Oliveira (2016). Research was carried out on this topic in the field of education, going through scientific articles and guiding documents for early childhood education. The authors mapped the paths and affections of babies and their relationships with objects in two distinct scenes that were collected within the scope of a collective project. It is a work that contributes to early childhood education in general and, specifically, to baby studies (Infantology, Babyhood studies). (shrink)

Resumo: Por intermédio da análise dos gêneros carta e conto escritos por Machado de Assis, procuramos oferecer uma resposta à questão do horizonte ético e moral que opera nos textos do autor. Trabalhamos numa perspectiva interdisciplinar, pois dialogamos com filósofos, historiadores e críticos literários procurando, num primeiro momento, demonstrar que a noção de cuidado de si se mostra na correspondência machadiana a partir da perspectiva de cura de si, isto é, um tipo de sabedoria dos antigos gregos e romanos que (...) o autor lança mão para realizar e organizar o pensamento literário, seu e de seus pares, na direção das publicações e conquistas no âmbito da literatura. Num segundo momento, demonstramos que o cuidado de si terá outro sentido nos textos de ficção, pois se volta para um cuidado da alma no sentido do desenvolvimento do pensamento crítico do sujeito em relação ao eu e ao outro, ao indivíduo e ao mundo social. The care of the self as an ethical perspective in Machado de Assis Abstract : Through the analysis of the genres letter and short story written by Machado de Assis, we try to offer an answer to the question of the ethical and moral horizon that operates in the author's texts. We work in an interdisciplinary perspective, as we dialogue with philosophers, historians and literary critics, trying, in a first moment, to demonstrate that the notion of self-care is shown in Machado's correspondence from the perspective of self-cure, that is, a kind of wisdom from the ancient Greeks and Romans that the author uses to accomplish and organize the literary thought, his own and his peers', in the direction of publications and achievements in the field of literature. In a second moment, we demonstrate that the care of the self will have another meaning in fiction texts, since it turns to a care of the soul in the sense of the development of the subject's critical thought in relation to the self and to the other, to the individual and to the social world. Le souci de soi comme perspective éthique chez Machado de Assis Résumé : A travers l'analyse des genres lettre et nouvelle écrits par Machado de Assis, nous essayons d'offrir une réponse à la question de l'horizon éthique et moral qui opère dans les textes de l'auteur. Nous travaillons dans une perspective interdisciplinaire, car nous dialoguons avec des philosophes, des historiens et des critiques littéraires en essayant, dans un premier temps, de démontrer que la notion d'auto-soin apparaît dans la correspondance de Machado dans la perspective de l'auto-cure, c'est-à-dire une sorte de sagesse des anciens Grecs et Romains que l'auteur utilise pour accomplir et organiser la pensée littéraire, la sienne et celle de ses pairs, vers des publications et des conquêtes dans le domaine de la littérature. Dans un deuxième temps, nous démontrons que le souci de soi aura un autre sens dans les textes de fiction, car il se transforme en soin de l'âme au sens du développement de la pensée critique du sujet par rapport au moi et à l'autre, à l'individu et au monde social.
